T-Mobile sued over text messaging

A few months back on our sister site, I talked about how to block incoming text messages. What surprised me was that at the time, T-Mobile didn’t offer a way to turn off text messaging. If you had a plan with them, you had to receive any text messages sent to you. They’re working on getting a better blocking system implemented, but until then, they’ll have to face another class action suit from consumers who aren’t too happy with their inability to block messages.
If you have customers who don’t want to receive text messages, and you don’t allow them to turn off the service and charge them for incoming messages, well, you should be able to envision a lawsuit in your future. The plaintiffs claim that the skinny on text messaging was no disclosed to them properly.
So it looks like we’re getting some use out of the Supreme Court ruling which allowed states to preempt mandatory arbitration clauses. Though we’ve seen a number of class actions filed before the ruling.
